14 September 2001 The Independent Complaints Directorate wishes to inform that Superintendent Jury Bernardus Hayes will be appearing in the Randburg Magistrates Court, on 15-16 October 2001. It is alleged that in February 1999 three civilians were arrested for drinking liquor in public in Linden. It is also alleged that the three aforesaid victims refused to have their fingerprints taken. As a result Supt Hayes, the Station Commissioner of the Linden police station, brutally assaulted them. The ICD investigated this matter immediately and after finalization thereof handed over the case docket to the DPP with recommendations that Supt Hayes be prosecuted for assault with intent to do grievous bodily harm. The DPP concurred with our recommendations and decided to prosecute Supt Hayes accordingly. The trial will commence on 15-16 October 2000 in the Randburg Magistrates Court. The Executive Director, Adv Karen McKenzie said: The ICD condemns in the strongest terms, police brutality. In this case, a Station Commissioner who ought to be exemplary in terms of effecting policing with due and serious regard for the Constitution and Bill of Rights, flouted his authority and position of leadership.
