MEDIA STATEMENT

The Independent Complaints Directorate (ICD) wishes to inform that Constable Mzamu Edward Mlomo (40), charged with the murder of Phindiwe Majobela (26), in October 2000, was found guilty and convicted in the Bizana High Court on Thursday, 25 July 2002.

The incident occurred in Mount Ayliff in the Eastern Cape Province on 09 October 2000 where Const Mlomo killed a civilian by shooting her four times and she died on the scene. Const Mlomo went to Mount Ayliff, next to the Magistrate’s Court, where the deceased was working as a hawker and shot her. Seven shots were fired. Const Mlomo who was stationed at the Mount Ayliff Stock Theft Unit, was drunk when he committed the murder. He and deceased quarrelled about fruit which he bought there.

The ICD took charge of the investigation immediately and after finalization thereof forwarded the case docket to the Director of Public Prosecutions (DPP) with a recommendation that the suspect be indicted for murder. The DPP concurred with the ICD’s recommendation and prosecuted Const Mlomo accordingly.

Const Mlomo was convicted of murder on 11 July 2002 and sentenced on Thursday, 25 July 2002, to life imprisonment. When passing the sentence the judge emphasized that the murder was pre-meditated.

The deceased was killed with the service firearm of Const Mlomo.
