The Independent Complaints Directorate (ICD) wishes to inform you that Inspector Frans Duba (38), who is stationed at SAPS Polokwane Criminal Record Centre, Limpopo Province, was convicted on murder in the Polokwane High Court on Wednesday, 19 February 2003.

The incident which claimed the life of Elias Morudu (43) who allegedly had an extramarital relationship with Insp Duba's wife, occurred on 24 December 2001 at Seshego in Limpopo. Insp Duba went to the deceased's house looking for his wife. On arrival he broke the bedroom window and started firing shots through the window. He shot the deceased six times, killing him instantly.

The ICD immediately took charge of the investigation and on finalization thereof, forwarded the case docket to the Director of Public Prosecutions (DPP) with a recommendation that Insp Duba be prosecuted on murder. The DPP accepted our recommendation.

On Wednesday, 19 February 2003, the Polokwane High Court, Limpopo, convicted Insp Duba of murder and sentenced him to 21 years' imprisonment.

Insp Duba's service firearm was used to kill the victim.

Judge E Jordaan remarked that the killing was premeditated. However, he also took into consideration the love triangle and emotional state of the police officer as metigating factors.
