The Independent Complaints Directorate (ICD) wishes to inform you that it is investigating the circumstances surrounding the death of Bheki Majola (25). The incident which claimed the life of Bheki Majola occurred on 28 January 2003 at Phoenix in KwaZulu-Natal. It is alleged that Mr Majola was stopped by Constable Shaheed Sayed at Fazil a few weeks before the incident and confiscated his cell-phone and ordered him to collect same at the Phoenix Police Station where he is stationed. The deceased proceeded on numerous occasions to the police station but to no avail. It is alleged that the deceased received no assistance from the members at SAPS Phoenix. Mr Majola was prompted to go to Const Sayed's house and still he couldn't attain his cell phone. It is further alleged that the suspect police officer noticed the deceased at a tavern and started to chase on him and fired a warning shot. Const Sayed fired another two warning shots. He continued to chase the deceased. The deceased jumped over a wall into the premises of 16 Central park Drive, Shastri Park, Phoenix and the suspect police officer followed suit. Allegedly he shot the deceased four times, killing him instantly. The ICD immediately attended the scene and took charge of the investigation. The suspect police officer was arrested on the same day and charged for Murder. He appeared in Verulam Magistrate's Court on 02 February 2004. He was remanded in custody for a formal bail application which was set for 10 February 2004 at Verulam Magistrate's Court. A service pistol was used to kill Mr Majola. The ICD has also taken over two case dockets pending against the suspect police officer. On one case he was charged for negligent use of firearm while on the other charged for Assault and crimen injuria. After finalization of investigation thereof the ICD will forward the case dockets to the Director of Public Prosecutions (DPP) for a decision on prosecution. Our investigation continues.
